Question:

Assalamu Alaikum. Hope your well. Ive got an inheritance question which  needs issuing from darulIfta.

The question:

Marhoom left behind total £115,000 in assets including house (worth £200,000) which he owned half.

According to the Islamic Law of Succession and Inheritance, distribution of an estate will only commence after funeral expenses, debts (including legal costs) and bequests (if any) made to non-heirs – which will not exceed one-third(1/3) of the Estate after debts and funeral expenses have been settled. Thereafter, all assets form part of the Nett Estate and will have to be distributed according to the Islamic Law of Succession and Inheritance.

 

We have been advised that the deceased is surviving by a wife, 5 sons and 1 daughter. Accordingly, the estate will be distributed in 88 equal shares as follows. If the deceased was also surviving by both or one of the parents or any other heirs not referred to in the question, the answer will not apply.

The remaining 0.05 % can be redistributed according to the shares mentioned above or given into sadaqa.

The entire estate amount of £115,000  will be divided into 88 shares. The result will be the value of one share. Multiply that amount with number of shares due to each heir. For example: the total estate is £115,000  . Divide this by 88 which is the value of one share which is £1,306.81 . Multiply this by the shares due to a person. For example the wife is entitled to 11 shares. Multiply 11 with £1,306.81.  The result will be the share of the wife.
